  • The signer must personally appear before the notary.
  • The signer must be alert, willing, and able to communicate directly.
  • Acceptable identification should be available whenever possible.
  • The document should be complete and unsigned if the signature must be witnessed.
  • The notary cannot determine capacity, select documents, or provide legal advice.

What families should know

Can a document be notarized if the signer is in a hospital?

A hospital stay does not automatically prevent notarization. The signer still must personally appear, communicate directly, show willingness, and meet identification and document requirements.

Can a family member answer for the patient?

No. The notary must communicate with the signer directly. Family and staff can help coordinate access but cannot direct the signer during the notarization.

Can you provide legal documents or advice?

No. A California notary cannot choose or prepare legal documents unless separately authorized by law. Contact an attorney or the appropriate professional if you need help deciding what document is required.

Are witnesses included?

Witnesses are not automatically included. Confirm the document requirements and arrange qualified witnesses before the appointment, or call to discuss the situation.
